Thebi-partisanWyomingBlockchainTaskForce,whichischarteredbythestatelegislature,isresponsiblefordraftingproposedlegislationforthestate.Inthe2018/2019legislativesessions,thestatepassed13crypto-friendlylawsdesignedtomakeWyomingthedestinationforcryptocompaniesandentrepreneurs.Thispastweek(September19-22),thestatehosteditssecondannualWyoHackathonattheUniversityofWyoming.Krakenwastheheadlinesponsorforthisyear’sevent,andcouldn’tbemoreproudtobeabletosupportthisandallofthegreatinitiativescomingoutofTheEqualityState.
ThereisnoindividualmorecloselyalignedtoWyoming’sblockchaininitiativesthancryptoandblockchainveteran,andco-founderoftheWyomingBlockchainCoalition,CaitlinLong.WespokewithCaitlinabouthowfarthestatehascomeinthecryptospaceandwhatshewasexcitedtoseeatthisyear’sWyoHackathon.(Responseshavebeeneditedforclarityandlength).
Afterspending22YearsonWallStreet,howdidyougetinvolvedwithcryptoandblockchaininWyoming?
ItallstartedwhenItriedtodonatebitcointomyalmamater,theUniversityofWyoming.However,IrandirectlyintoWyoming’sbadmoneytransmitterlaw(MTL).Wyomingwasoneof3stateswithbadlanguageinitsMTLthatpromptedleadingcompaniestoleavethespace.Theschoolcouldnotfindanyonetoexchangebitcoinforfiatsotheyhadtodeclinethedonation.
Isaidtothem,“let’sgetthisfixedbecauseI’mnottheonlyonewhoisgoingtorunintothis.”That’swhatgoteverythingstarted.
WhatarethemainthrustsofWyoming’slegislativeefforts?
First,Wyomingistakingahands-offapproachtothecryptocurrencyindustryanddecideditsexistingfraudandtheftlawswouldbesufficienttoprosecutecriminals.
Second,Wyomingclarifiedthattherewillnotbetaxesoncryptoassetswithinthestate.
Third,andthisisreallyimportanteventhoughitisgoingtosoundboring,weclarifiedthelegalstatusofcryptoassetswithinWyoming.Thisiscriticalbecauseitprovidesroadmapsforitemssuchasdisputeresolutionorhowtocreatealienagainstacryptoasset.
Wealsocreatedadigitalassetcustodyregimethatisconsistentwith“NotYourKeys,NotYourCoins”.Similartodroppingoffyourcarkeyswithavalet,youarenotgivingupownershipandexpecttoreceivetheexactsamecarwhenyoureturn.Valetscannottakeyourcarforajoy-rideorgiveyouasubstitutecar.Theyoweyouyouractualcarback.Fordigitalassetpurposes,thislawmeansacustodiancanonlyuseyourassetsinmannersinwhichtheyaredirectedtobyyou.
Howmanycompanieshaveformedlegalentitiesinthestate?Whoisregistering/domicilingintheState?
Thereareuptoseveralhundredifnotthousandsofcryptocompaniesthathavelegally(notphysically)domiciledinthestate.JustlikeinDelaware,companiescanregisterandgainsomeofthelegalprotectionswithoutactuallylocatingthere.
However,wehavealsocreatedanewtypeofregulatedfinancialinstitution,knownasaSpecialPurposeDepositoryInstitution,thatwillserveasabridgebetweencryptocompaniesandthetraditionalfinancialsystem,whichwillleadtomorecompaniesdomicilingphysicallyinthestate.Theseinstitutionswillhavemanagement,legalandcompliance,andITteamsphysicallylocatedinthestatestartingnextyear.Avastmajorityofcryptocompanieshavehadissuesobtainingorretainingbankaccounts,andWyomingistryingtosolvethatforthecryptoindustry.

Ithinkitisretailinvestorslookingforareliablestoreofvalueamidthecracksinthetraditionalfinancialsystem.I’vespokeninthepastaboutsignificantissuesthatIencounteredonWallStreetthatjustpunchedmeinthegut,astheywereunfairtomomandpopinvestors.ThereisalotofthatonWallStreet,andtherearealsoalotofwell-meaningpeoplethatjustdon’tunderstandhowthesystemworks,whichalsodisadvantagesretailinvestors.
Cryptosolvesalotoftheseproblems,soasmorepeoplelearnthattheincumbentfinancialsystemisunstableandunfairtothem,theywilllooktodiversifytheirassets.
Bitcointendstodowellintimesofgeopoliticalinstabilityaswell.AsNicholasNasimTalibpointsoutyoucancrossborderswithbitcoinbymemorizingyourrecoveryseed,andnototalitariangovernmentwouldeverknowyoudidit.
Whataretheusecasesforcryptothatyoufindmostinteresting?
Clearlystoreofvalueisabigusecase.Paymentsisanotherone.Iseeadouble-edgedswordwhenitcomestoFacebookandLibra,butIthinkthereisalotofpositivethatcancometothecryptoindustryifFacebooksuccessfullylaunchesLibra.
Thethird,andmostsignificant,isgettingcapitalmarketsswitchedovertocrypto.ThiswillsolvealotofunfairnessonWallStreet.Forexample,intheU.S.therearethreepeoplewhothinktheyownaUSTreasurybondforeveryonewhoactuallydoes.Auditingrulesdonotpickthisup.Thissortofthingisadirectviolationofpropertyrights,anditisoneofthereasonsIloveWyomingbecausethiswouldneverhappenhere.Wyominggivesveryclearly-definedpropertyrightsforcryptoassets,andwewillneverhavea“musicalchairs”typeofscenariothatexistsinthefinancialindustryinwidespreadquantities.
